# Terms of Service

## 1. Scope and contact details

These terms govern orders for goods through https://elarova.shop and use of this online store. Our delivery area is Australia. “We” and “us” refer to Elarova; “you” refers to the person placing an order or using the website.

The terms provided when you place your order apply to that purchase. Individually confirmed agreements and mandatory statutory rights take precedence. These terms do not restrict the Australian Consumer Law.

## 2. Placing an order

You must have the legal capacity to enter into the purchase contract and be authorised to use your chosen payment method. Please provide complete and accurate contact, payment and delivery details. You can review the order summary and correct errors before submitting your order.

If you use a customer account, protect your login details and let us know if you suspect unauthorised access. You are not automatically responsible for every third-party action simply because it occurs through your account; responsibility depends on applicable law and the circumstances.

## 3. Products and descriptions

Your purchase is based on the product description, selected variant, quantity and characteristics displayed before checkout is completed. Screens may display colours differently. This does not justify supplying goods that differ materially from the agreed description or limit your statutory rights.

Please consider the stated measurements, materials, and care and use instructions. Contact us before ordering if you have questions. General images do not promise characteristics that have not been expressly agreed.

## 4. Prices, currency and payment

Prices and payments are in Australian dollars (AUD). Displayed consumer prices include GST where applicable and any other price components that must legally be included. Standard shipping within Australia is free, with no minimum order value.

The total shown before purchase applies to your order. Optional extras require your selection. We do not impose mandatory fees disclosed only after you have completed your order.

You may choose from the payment methods actually displayed at checkout. Processing requires confirmed payment. If there is a payment problem, we will notify you where we can contact you. Later general price changes do not alter the price of orders already accepted.

## 5. Order acceptance and formation of the contract

By submitting an order, you offer to buy the selected goods. An automatic acknowledgement initially confirms receipt only. We accept your order by sending an express acceptance or dispatch confirmation. A message that expressly accepts your order forms the contract even if it is called an order confirmation.

Before acceptance, we may decline an order for a valid reason, such as unavailability, missing payment authorisation or specific indications of misuse. We will refund amounts already collected for an order we do not accept within 5 calendar days of notifying you of the rejection.

If we identify a pricing or description error, we will notify you and discuss the next steps. We will not unilaterally change an agreed price. Applicable law governs contracts already formed; this clause does not give us an unrestricted right to cancel them.

## 6. Changes, cancellations and availability

Please send requests to change or cancel an order to kontakt@elarova.shop as soon as possible. Before dispatch, we will check whether the request can still be carried out. A shipment already in progress cannot always be stopped. Your returns options and statutory rights remain unaffected.

If an ordered item cannot be supplied, we will inform you. An alternative item or longer waiting period will only be arranged with your agreement. If no such arrangement is agreed and the order is cancelled, we will refund the relevant amount within 5 calendar days of confirmation. Your bank may take additional time to credit the funds.

## 7. Shipping and delivery

Our [Shipping Policy](https://elarova.shop/policies/shipping-policy) explains delivery areas, charges and time calculations. Handling takes 1–2 business days, followed by 5–7 business days in transit, giving an estimated total of 6–9 business days. Business days are Monday to Friday, subject to the public holiday rules in that policy.

The order cut-off is 5:00 pm Sydney local time, in the Australia/Sydney time zone: AEST (UTC+10), or AEDT (UTC+11) during daylight saving. Orders placed at or after the cut-off, or on non-processing days, are assigned to the next processing day. This applies to recipients in other Australian time zones as well.

Please report missing deliveries or delivery concerns to us. Handing a parcel to a carrier does not release us from our statutory obligations. If significant disruption occurs, we will notify you and work towards an appropriate solution. Exceptional events do not result in a blanket exclusion of your rights.

## 8. Returns, refunds and exchanges

Our [Returns and Refund Policy](https://elarova.shop/policies/refund-policy) sets out our voluntary returns offer, the process and responsibility for costs. It also explains refunds and exchanges. Statutory rights apply independently of the voluntary offer.

Please do not automatically use our business address for returns. Our customer service team will provide the appropriate shipping instructions.

## 9. Consumer rights and liability

Consumer guarantees under the Australian Consumer Law remain fully applicable. These include legally required standards of quality, fitness for purpose and correspondence with the description. Remedies for a problem depend on the legal requirements and the nature of the problem.

These terms do not impose a blanket liability cap equal to the order value or exclude compensation required by law. Payment provider terms, manufacturer terms and additional warranties cannot remove mandatory rights you have against Elarova.

## 10. Acceptable use of the website

You may use the store to browse information, place orders and contact us. Prohibited activities include fraudulent orders, distributing malicious software, attempting unauthorised access and unlawfully disrupting the website.

Where there is specific evidence of misuse, we may restrict the relevant access proportionately. This does not affect existing rights relating to orders, returns or statutory consumer protections.

## 11. Content and third-party rights

Text, images, logos and other content may be protected by copyright or other rights. Reproduction or commercial use beyond what the law permits requires the relevant rights holder's consent.

Reviews or other content you submit must not infringe third-party rights or contain unlawful or misleading material. Submitting content does not automatically transfer all rights in it to Elarova.

## 12. Privacy and external services

Information about the handling of personal information is provided in the store's separate Privacy Policy. These terms do not replace that information. External websites and payment services may have their own terms. Our own statutory obligations to you remain unaffected.

## 13. Complaints and governing law

You may send complaints to kontakt@elarova.shop, including your order number and a description of the issue. We will review your concern and advise you of the next steps. Contacting us first is not a requirement for using legally available complaint or legal processes.

These terms are governed by the laws of New South Wales and applicable Australian federal law, including the Australian Consumer Law. Mandatory rights available to you under other applicable Australian laws remain unaffected. These terms do not impose an exclusive jurisdiction that excludes legally competent courts or tribunals.

## 14. Changes to these terms

Updates apply to future orders after the revised version is made available. A later change to this page does not, by itself, change a contract already made. If a provision is invalid, the applicable law governs and the remaining provisions continue to apply to the extent legally possible.
